I hope her damage is to the front of her car, for your sake. Here in Illinois, the car with the frontal damage gets charged with the accident. I'm curious how you had time to honk but not stop. Just wondering.

Are you telling me that even if it was clearly the other person's
fault the car with frontal damaged car is charged?
They don't even stop to consider it?
I don't think that's true.
I don't see how that can even be made a general statement by Illinois law enforcement or whoever.
There are always circumstances that one has to consider.

And yea:
"completely oblivious to my scretching tires and my honking my horn"

well thats not not afront end accident thats a side swipe. if they took pictures of her cars damage then they should be able to see exactly how the damage is on her car and can easily tell if she swiped you or you hit her. paint scraps and bent metal will show that!

but definatly talk to that ladies insurance company! because they SHOULD pay for it! but you need to take the car to a alignment shop to see what all is damaged. most likely it bent the lower control arm or maybe upper from that hit, check the upper strut tower to see if its bent around the upper arm mounts.
youd also want to have the rim checked for bends as well, cause i see that the hubcap was smashed into the rim, so it could also have bent the rim to cause a vibration.
but for the time beeing if you have to drive it just remove that fender or at least the inner plastic fender liner. cause that looks pretty close to the wheel.

but doesnt look to bad..... but sometimes the cars cheaper to replace than rebuild.... PERSONALY i would buy it back if they do total it and fix it and use the extra cash for extra parts...





and on a side note old people will probably always get a liscence because people at the liscence brand feel sorry for them!
I KID YOU NOT!!!!!! when i was at the liscence branch renewing my old liscence plates this older lady was renewing her liscence and it took her 2-3mins on the EYE test thing TO READ THE WRONG LINE VERY SLOWLY! another 3-4mins to YES READ ANOTHER WRONG LINE VERY SLOWLY AGAIN, and then 2-3 mins to start reading the right line (suposedly) for all i know the liscence brand lady just said YA THATS RIGHT and it still been the wrong line!
i was freaked out like WTF!!!!!!!! hell if i got 1-2 letter wrong im sure they would have said NO you need glasses or i read the line THAT SLOW!
i was just ready to leave long before she left!

not here in tn last year a old man hit my wife in the left rear quarter panel and they said she was at fault. they tried to get her for failure to yield but we fought the charge and won we i went down to the crash site there where no skids marks from his car and his cell phone was in the pass side floor board. so that tells me he was on the phone didn't see my wife and t-boned her he is 70 years old

Since in court most accidents come down to he said/she said, here in Illinois they tend to say the person with the frontal damage had the best chance of avoiding the accident, and thus gets charged with the accident. I am not saying who is at fault, just who is going to get blamed.

By the way, most accidents are caused by the newer drivers, not the old geezers. My 90 year-old mother stopped driving at 88 with a blemish free record. Why do you think insurance rates are highest for younger unmarried drivers? I am 65 and only pay $350/ 6 months for full coverage on my '06 LX.

I too have met my share of older drivers that should not be on the road. I am guessing that the older drivers have fender benders and the youngsters have the more serious ones, thus the higher insurance rates.

good grief your 65 and pay $350 every 6 months, i'm going on 41 and pay the same amount.

I wouldn't go that far. Yes, younger drivers get into a lot of accidents because they are careless, and don't put forth enough effort towards paying attention. That, and you've got all the "I'm 16 years old and indestructable!" kinda kids.

However, old people most times don't have the ability to react in time under emergency circumstances. Reaction times are slower, sight/hearing isoften weaker, and for crying out loud a lot of them drive so slow that its dangerous. 45mph on a 70mph limited highway? That is not safe, at all.[/blockquote]
