Default Injen intake question

I just bought a 97 ex and the previous owner put an injen cold air intake on it. It is the extended one that puts the filter down in the bumper. The problem is that there is an odd looking piece that joins the top tube to the bottom. It is some sort of disc with rubber flaps in it that let more are in at high rpms. It is surrounded by a foam filter to try to clean that air I guess. I've looked online and I can't find any info about this piece. The one I have is broken and the foam is torn. Any ideas where I can get a replacement? If not, should I try to eliminate this? Thanks for any help.
