I heard that bypass valve only work if the intake is completely underwater.

 

yeah, but it also wont get a whole breath of water if the filters not completely under water. and no, it doesnt hurt the Cold Air aspect, it is closed until the filter is submerged, then it opens to let air in there, instead of water up the pipe.
