was it a double yellow line? Then hes 110% @ fault. Were there any "No Left Turn" Signs posted? How long were his skid marks? Yours? Was he speeding? How much faster than you? Was he on the Phone? These are all things u should be prepared to answer when u go to court. Bring pictures of the road, and any signs if there were any. Ive taking quite a bit of Criminal Justice classes, and unfortunatly it seems that you are possibly at fault. It depends on what part of the car u T boned him at. That shows how far into the turn he was when u hit him, which will give them a good idea how early he turned infront of u. Did u get a ticket? If u did, then u were at fault. (i.e. careless driving, reckless driving, etc)

On the bright side, it sounds like it wasn't your fault and someone drivign a Lexus is bound to have insurance, so now you can start a new project.

That really sucks! I guess everyone agrees that you should check out your injuries whether at the hopital or your private doctor. Anyway, thank God you are okay. I've been there and it's no laughing matter.

He has no insurence so I plan to take him to court for the value of my car and the aggrevasion of not having a automobil being I work damn near 20 miles from my home.

hes at fault. Under no circumstances are u allowed to cross a double yellow line, not to pass, and not to turn (unless the lines stop for 10 feet and then start again. Man go take pics, theyll definetly help.

 

bummer about your car. at least you're ok, minus the aches and whatnot. i can't believe the lexus didn't have insurance, that's going to be a butt trying to get any money out of it. definitely take pics like pcupo says, and were there any witnesses?

If you smacked your knee on the dash I'd really get it checked out. That's how people screw up their PCLs and those aren't that fixable.
